Access and Use of the Site

-You must only use the Website in accordance with these Terms and Conditions and any applicable law.
-You must not (or attempt to):
-interfere (or attempt to interfere) or disrupt (or attempt to disrupt) the Website or the servers or networks that host the Website;
-use (or attempt to use) data mining, robots, screen scraping or similar data gathering and extraction tools on the Website; or
-interfere (or attempt to interfere) with security-related or other features of the Website.
-To place Orders and access some features of the Website, you must register an Account with us. To register an Account, you must:
-give us accurate and current personal information including your name, address, phone number, and a valid email address.
-you must be at least 18 years old, and have the capacity to enter into a legally binding agreement with us.
-You are solely responsible for the activity that occurs on your Account (including Orders placed using your Account), and you must keep your Account password secure. We are not responsible for any unauthorised activity on your Account if you fail to keep your Account login information secure. We may refer fraudulent or abusive or illegal activity to the relevant authorities.
-You must not use another person’s Account without our, and/or the other person’s, express permission. If you suspect or become aware of any unauthorised use of your Account or that your password is no longer secure, you must notify us immediately and take immediate steps to re-secure your Account (including by changing your password).
-We do not warrant that the Website will be available at all times and without disruption and we provide no warranties in relation to the content of any other website linked to or from our Website.

Returns and Exchange Policy

Your satisfaction is our main concern. If you are unhappy with any stock item you can return it for an exchange or store credit. If an item is deemed to be faulty and we cannot replace the item like for like, a refund may be granted within 14 calendar days of receipt of goods; refunds will be issued in the

same form as the original payment. There is no return or exchanges on custom ordered products.
The product you return must be in: new, unused, pristine and unmarked condition, with all the original packaging in unmarked, saleable condition. Proof of purchase must be provided for all returns. Proof of purchase can be in the form of a receipt, credit card statement, or sales order form.

Special Order items (which are indicated online as such) are not able to be returned or exchanged, as they are ordered by customer request.
Products can be returned to our warehouse. If you are sending the item back to Ultimate Stones warehouse please notify us before you return the item by email (info@ultimatestones.com.au) so we can provide you with a returns form and the instructions for returning your items. If you would like to request an exchange you can let us know at this time of your new selection, so we are able to reserve this for you.
Faulty items: If you receive an item that you consider to be flawed or faulty upon delivery, please contact us immediately to discuss its repair or replacement by email (info@ultimatestones.com.au).

Ultimate Stones is not responsible for any item that is not returned in a new, unused and unmarked condition. We do not sell imperfect items and will not accept the return of any item, which is considered marked or imperfect.
Please also note that packaging is an inherent part of the product, and a full refund or credit will not be issued if the packaging is not returned.

Delivery of your goods within Australia

All parcels are sent via Australian Post Office, e-parcels or express packages within Australia. All parcels need to be signed for on delivery, so we recommend use of a business address if there will not be someone home during business hours. If your parcel cannot be delivered you will receive a notification card and the item will be available at your local post office for collection. If not collected, it may be returned to Ultimate Stones and any re- delivery charges will be charged to the customer.
You can check on the progress of your delivery any time using the link sent to you via email upon dispatch of your order. If at any time you are concerned about your delivery you can email info@ultimatestones.com.au.

Pricing and Payment Method

All prices are in Australian dollars (AUD) and include GST. We take great care to try and avoid errors in pricing and product information. If mistakes occur we reserve the right to correct them online and instore.

PRIVACY POLICY

We are committed to protecting your privacy and we will only use the information that we collect about you lawfully. We collect information about you for 2 reasons: firstly to process your order and second, to provide you with the best possible service. We will not pass your information onto a second party and we will give you the chance to unsubscribe from any marketing emails from us.
The type of information we will collect about you includes your name, address, phone number, email address and/or credit/debit card details. We will never collect sensitive information about you without your explicit consent and we always dispose of credit card details after your transaction has been made. The information we hold will be accurate and up to date. You can check this information by emailing us. If you find any inaccuracies with the information we hold we will delete or correct it promptly.

We may use technology to track the patterns of behaviour of visitors to our website. This can include using a ‘cookie’ which will be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.

Delivery Address and Special Instructions

Please provide us with a ground floor delivery address where deliveries can be made during normal business hours from Monday to Friday. A post office box address or parcel locker cannot be accepted.

Please provide clear delivery instructions within the “Special Delivery Instructions” area of the checkout. Many of the products on our website are heavy in nature and may require special delivery arrangements. It is imperative that you provide us with any special delivery details relating to your delivery address. Should your delivery address be in an apartment block, high rise building, block of units or flats or have restricted access you must notify us at the time of order, so that special arrangements can be made if necessary. We reserve the right to charge for any additional freight costs involved with making or fulfilling any special delivery arrangements.

Delivery Cannot be Completed

You are responsible for providing us with the correct delivery address. If you provide an incorrect address and as a result we are unable to successfully deliver your order to you after [21] days or [1] delivery attempts (whichever occurs sooner) we reserve the right to charge you any additional re-delivery charges or cancel your order and the provisions of section above of these Conditions will apply. For this reason, it is vital that you ensure you have provided the correct address, email address and telephone number as we may use this information to contact you in the event we are unable to deliver your order.

Returns Policy Liability

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a

major failure. For further information as to your rights under the Australian Consumer Law, please visit the Australian Consumer Law website.

Subject to section above, to the full extent permitted by law (including under the Australian Consumer Law), we exclude:
all other guarantees, warranties, conditions and other terms whether express or implied and whether arising from statute, common law, trade custom or otherwise; and

all liability for loss of profits or revenue, loss of anticipated savings, loss of contract, loss of goodwill, loss or interruption of business, loss of data, and any other loss or damage of any kind.

Where any guarantee, warranty, condition, liability or other term cannot be lawfully excluded then, to the extent permitted by law, our maximum liability to you is limited to the amount paid by you for the goods in question

Except to the extent required by law (including the Australian Consumer Law), we will only consider and, if applicable, provide a refund, replacement or repair if it has been claimed in accordance with the procedures set out in this Returns Policy.

How To Make A Claim

We strive to ensure that our goods meet or exceed your expectations on delivery. However, occasionally goods may not arrive in the condition that we intended them. If you need to make a claim for a refund, replacement or repair in respect of goods supplied by us, please follow the procedures set out below.

If your products were damaged in transit
In the unlikely event that you receive an item that has been damaged in transit, please contact us via email; info@ultimatestones.com.au within 24 hours of discovering the damage and include your order number, description of the issues and clear photographs showing the damage. We will try to resolve the situation as soon as possible.

Without limiting any statutory rights you may have (including those referred to (above), we may, as an alternative to offering a replacement, provide an alternative solution such as:

-contributing to the cost of having the item fixed locally based on quotations;
-compensation for you to repair the item yourself;
-giving you the item at a discount

-sending you replacement/missing parts at no charge;
-offer a partial or store credit voucher or refund.

We will arrange for the collection and return of any damaged item which we have agreed to refund or replace at our cost.
If your goods have a manufacturer’s fault/flaw

In the unlikely event that you receive an item that has a manufacturer’s fault or flaw, please contact us via email: claims@interiorsonline.com.au within 7 days of discovering the fault/flaw and include your order number, description of the issues and clear photographs that show the fault or flaw. We will aim to resolve the situation as quickly as possible for you.
Without limiting any statutory rights you may have (including those referred to in section
-we may, as an alternative to offering a refund or replacement, provide an alternative solution such as:

-contributing to the cost of having the item fixed locally based on quotations;
-compensation for you to repair the item yourself
-giving you the item at a discount;
-sending you replacement/missing parts at no charge.

We will arrange for the collection and return of any faulty or flawed item which we have agreed to refund or replace at our cost.

Please note that we do not generally consider minor variations in colour, dimensions, finish or naturally occurring characteristics to be faults or flaws.

This section does not affect or limit your rights under the Australian Consumer Law.

If the incorrect item has been delivered to you

Please contact us via email: info@ultimatestones.com.au within 24 hours of the delivery of an incorrect item. We will arrange for the collection of the incorrect item and delivery of the correct item. You will not incur any additional costs in this circumstance. Your replacement item will be delivered to you within the normal delivery time frame for that item. In the event the item ordered is unavailable, we will offer an alternative product, store credit or a full refund.

Faults and warranty claims

If an item arrives that is defective it will assist in any warranty claim if you take photos or video clearly illustrating the problem and contact us as soon as possible, ideally within 2 business days of your delivery.

We will not be responsible for:

-insignificant minor imperfections or superficial blemishes;
damage, wear and tear as a result of improper or lack of maintenance and/or care (eg fabric, leather or timber);
-insignificant minor variations in dimensions, colour;
-damage arising from improper assembly or modification;
-damage caused by you or damage arising from abnormal use or abuse;
-damage to external or product packaging only;
-damage occurring during your own handling and transportation of the item.

Change of Mind returns

In the event that you would like to return an item due to a change of mind, it must be discussed with one of our sales team within 48 hours of receiving the goods. Any return on this basis is at ours’ and our supplier’s absolute discretion. If agreed, you are to arrange your own freight back to the supplier at your cost and at your risk.
We require the returned product(s) to be unused and in the original packaging. Any items that are not returned to us in the original packaging and/or in original condition will incur an additional handling fee (deducted from your refund). This also includes not packing the item up sufficiently to avoid damage in transit back to us. Please use the packing material the item was sent with.

Returning items may also incur a re-stocking and administration fee which will be discussed with you prior to the return of the goods.

We reserve the right to only provide a store credit in exchange for returned goods. That store credit will be valid for 6 months, unless otherwise advised by us at the time we are considering your claim. The credit will include deductions for the actual delivery charge to originally deliver the item/s. This may vary from the charge on your original order as freight charges are subsidised by us.

Please note we will not consider any “Change of Mind” return request for:

-special order items;
-items that are made to order;
items which we reasonably consider were purchased for commercial use or non-domestic use.

You must comply with all proprietary and copyright notices on this site. This website is owned by Ultimate Stones Pty Ltd and and subject to copyright. The information on this Site is protected under Australian copyright laws.
Subject to provisions of the Copyright Act 1968 (Australia), you must not in any form or by any means: (a) copy, adapt, reproduce, broadcast, store, transmit, distribute, print, publish or create derivative works from any information or material on this Site; (b) alter, de-compile, disassemble, reverse engineer or modify any material or information that you receive from this Site which can be accessed through this Site; or (c) use or apply, for commercial purposes any material or information on this Site, without the prior written consent of Ultimate Stones.

Any software which you download from this Site is governed exclusively by the licence terms accompanying the file or the terms of the licence agreement which accompanied the original product licensed by you which you are updating, and by down loading such software you agree to abide the terms of the licence. Product Description And Information

We rely on information provided to us by our suppliers to describe items on our website. Sometimes it is possible that our website will contain errors and we reserve the right to correct any errors or inaccuracies at any time, whether before or after you have placed an order.

In most cases the items we offer are handmade or made from natural or organic materials. In these cases there may be variations between the

product image(s),its patterns and the product you receive. This will always be stated on the individual product listing.

We try to ensure that all colours are displayed accurately, but colours may appear slightly differently on different displays and screens. The shade of colour from screen to screen is not a fault or error. This will be regarded by us as a change of mind and returning items based on change of mind will be at the expense of the customer “If you change your mind”).

To the extent applicable at law, we do not warrant that the product descriptions, colours, information or other content available or offered on our website are accurate, complete, reliable, current or error free.

In some cases we are unable to deliver products to you or the products delivered are not of sufficient quality or workmanship. We reserve the right to withdraw any items from our website at any time and/or remove or edit any materials or content on our website.

We will not be liable to you or any other third party by reason of our withdrawing any item from our website, whether it has been sold or not, removing or editing any materials or contents on our website.

Legal Capacity

-You must be eighteen (18) years of age or over to register as a member of the website or purchase products from the website.

-Any Order and/or purchase made by you using this website is an acknowledgement by you that you:
-are over the age of eighteen (18) years
-accept these terms;
-agree that you have entered into a legal contract with Ultimate Stones in relation to these terms; and
-these terms, together with your order, constitute the entire agreement between you and Ultimate Stones for the supply of products.

-Ultimate Stones reserves the right to take legal action and seek compensation from the parent or guardian of a minor who causes an order to be placed, for any loss or damage Ultimate Stones may suffer as a result of a transaction entered into by a minor.
